Agreement to These Terms

These Terms and Conditions govern your access to and use of HomesReach, including our website, platform, accounts, property discovery tools, landlord workflows, tenant interactions, investor opportunity discovery features, messaging, document uploads, verification workflows, payment-related features, and support services.

By accessing or using HomesReach, you agree to these Terms. If you do not agree, you should not use the platform.

About HomesReach

HomesReach is a Canada-focused real estate platform designed to support property discovery, user inquiries, landlord and tenant workflows, investor-oriented opportunity discovery, communications, document handling, verification steps, payments, and support operations.

HomesReach is a technology platform. Unless clearly stated in a separate written agreement, HomesReach does not act as your legal, financial, tax, investment, brokerage, property management, insurance, or professional advisor.

Eligibility

You may use HomesReach only if you are able to form a binding agreement and comply with these Terms. You are responsible for ensuring that your use of the platform is lawful and appropriate for your circumstances.

If you use HomesReach on behalf of a company, landlord, property owner, investor group, or other organization, you represent that you have authority to act on its behalf.

Accounts and Account Responsibility

You may need an account to access certain features. You agree to provide accurate, current, and complete information and to keep your information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify HomesReach promptly at info@homesreach.ca if you believe your account has been accessed without authorization.

HomesReach may refuse, restrict, suspend, or terminate accounts where we reasonably believe there is inaccurate information, misuse, risk, fraud, abuse, policy violation, or harm to the platform or other users.

Acceptable Use

You agree not to misuse HomesReach. You must not use the platform for unlawful, fraudulent, misleading, abusive, or harmful purposes; submit false, inaccurate, deceptive, or unauthorized information; impersonate another person; upload malicious code; scrape or harvest user data, listings, contact details, or platform content; send spam or unsolicited bulk messages; harass or abuse other users; circumvent security controls; or use HomesReach in a way that harms deliverability, trust, safety, platform reputation, or service availability.

You are responsible for complying with applicable tenancy, housing, real estate, consumer protection, privacy, anti-spam, tax, financial, and other obligations that apply to your activity.

HomesReach may investigate activity that appears to violate these Terms and may take action to protect the platform, users, providers, and the public.

User-Submitted Content

You may submit listings, descriptions, photos, documents, messages, inquiries, profile details, investment opportunity information, applications, support materials, and other content through HomesReach.

You are responsible for the content you submit. You represent that you have the rights and authority needed to submit it and that it is accurate, lawful, and does not infringe the rights of others.

By submitting content, you grant HomesReach a non-exclusive, worldwide, royalty-free licence to host, store, process, display, transmit, reproduce, modify for formatting, and use that content as needed to operate, improve, secure, and provide the platform.

HomesReach may remove, restrict, or decline content that appears inaccurate, unlawful, misleading, abusive, infringing, unsafe, or inconsistent with these Terms.

Listings, Properties, and Opportunities

HomesReach may display property information, rental opportunities, landlord workflows, tenant interactions, and investor-oriented opportunities submitted by users or third parties.

HomesReach does not guarantee that listings, availability, prices, terms, projected returns, property details, ownership information, approval criteria, or opportunity descriptions are accurate, complete, current, or suitable for you.

Users are responsible for conducting their own due diligence before making decisions, entering agreements, sending funds, uploading sensitive documents, or relying on information found through the platform.

Verification, Documents, and Reviews

HomesReach may offer document upload, identity, eligibility, fraud-prevention, payment, or KYC-style verification workflows. These workflows may be supported by third-party providers.

Verification steps do not guarantee identity, approval, eligibility, reliability, legal compliance, financial qualification, tenancy approval, investment suitability, or transaction completion. HomesReach may accept, reject, pause, or request additional information as part of platform risk and support operations.

Payments

HomesReach may support payments or payment-related workflows through third-party payment processors. Payment processing may be subject to additional terms from the payment provider.

HomesReach does not guarantee that a payment will be authorized, completed, reversed, refunded, or available within any specific timeframe. Users are responsible for reviewing payment details, fees, obligations, refund rules, and transaction terms before proceeding.

Communications

HomesReach may send service, transactional, security, verification, support, account, payment, and policy communications. These messages are part of operating the platform.

HomesReach may send promotional communications where permitted and where appropriate consent has been obtained. Marketing emails will include an unsubscribe method where required. Unsubscribing from marketing messages does not prevent HomesReach from sending necessary service, security, support, account, or transactional messages.

Users may not use HomesReach communications tools for spam, purchased-list outreach, deceptive messaging, harassment, unlawful promotions, or other abusive activity.

Third-Party Services

HomesReach may rely on third-party providers for hosting, analytics, document storage, identity verification, payment processing, email delivery, communications infrastructure, customer support, security, and related operations.

Third-party services may have their own terms and policies. HomesReach is not responsible for third-party services that we do not control, but we may use them to provide and improve platform functionality.

Platform Availability

HomesReach aims to provide a reliable service, but we do not guarantee uninterrupted, error-free, secure, or continuously available access. The platform may be unavailable due to maintenance, updates, technical issues, outages, provider failures, security events, or circumstances outside our control.

HomesReach may modify, suspend, restrict, replace, or discontinue any feature or part of the platform at any time.

Intellectual Property

HomesReach, including its name, branding, website design, platform structure, software, content, and related materials, is owned by HomesReach or its licensors and is protected by applicable intellectual property rights.

You may not copy, reproduce, modify, distribute, reverse engineer, or exploit HomesReach materials except as permitted by these Terms or with written permission.

Disclaimer of Warranties

HomesReach is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, HomesReach disclaims warranties, representations, and conditions of any kind, whether express, implied, or statutory.

HomesReach does not guarantee property availability, listing accuracy, investment performance, tenancy approval, user conduct, verification outcomes, payment success, communications deliverability, uninterrupted service, or any particular result from using the platform.

Limitation of Liability

To the fullest extent permitted by applicable law, HomesReach and its owners, operators, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising from or related to your use of the platform.

HomesReach's total liability for any claim related to the platform will be limited to the amount you paid to HomesReach for the specific service giving rise to the claim, if any, during the three months before the claim arose. Some limitations may not apply where restricted by applicable law.

Indemnity

You agree to defend, indemnify, and hold harmless HomesReach from claims, losses, damages, liabilities, costs, and expenses arising from your use of the platform, your submitted content, your violation of these Terms, your misuse of communications tools, or your violation of rights or obligations owed to another person or organization.

Suspension and Termination

HomesReach may suspend, restrict, or terminate access to the platform if we reasonably believe you have violated these Terms, created legal or operational risk, provided inaccurate information, misused communications, engaged in fraud or abuse, or harmed users, providers, or platform integrity.

You may stop using HomesReach at any time. Certain provisions of these Terms will continue to apply after account closure where necessary for enforcement, records, payments, disputes, or legal obligations.

Changes to These Terms

HomesReach may update these Terms from time to time. Updated versions will be posted on our website with a new effective date. Continued use of the platform after changes are posted means you accept the updated Terms.

Governing Principles

These Terms are intended to be interpreted in a practical and enforceable manner consistent with applicable laws in Canada. If any part of these Terms is found unenforceable, the remaining parts will continue to apply.
